Cloud Terms of Use

Cloud Terms of Use

These conditions apply, in addition to the EMMU Score Terms of Use, to the personal-only cloud storage and cross-device synchronisation feature (“Personal Cloud”). If these conditions conflict with the Terms of Use, these conditions take priority for Personal Cloud. However, liability for damages follows Article 19 of the Terms of Use, and non-excludable statutory rights and protections in the additional regional terms take priority.

Article 1 — Use of the Cloud

  1. When a registered user agrees to these Conditions and enables the feature, we store eligible score data and setlists on our servers and synchronize them between registered devices authenticated with the same account.
  2. This cloud service is exclusively for the user to store and use their own scores. It does not include sharing, publication or joint use with other users or third parties.
  3. Personal Cloud storage and synchronisation do not replace separate retention of Source Materials. Do not discard or delete Source Materials; under Articles 7 and 13 of the Terms of Use, retain materials that you may lawfully keep independently of the Service. Synchronisation may propagate changes and deletions to other devices. Synchronising to another registered device alone does not establish an independent backup.

Article 2 — Scores That May Be Stored

Eligible scores must be lawfully obtained through purchase, creation, legitimate free distribution or other lawful means for the user's own viewing, creation, editing or performance, with the rights, permissions or other lawful basis also needed for cloud copying, storage and synchronization. Created or edited scores saved to the library include lyrics, chord names and retained import information. Recordings, drafts not applied to the library and editing history are excluded from synchronization. Edits also propagate to other devices, so synchronization alone does not preserve a separate pre-edit original.

Article 3 — Prohibitions

Users must not do the following.

  1. Lend or transfer an account or registered device to a third party, or allow joint use by a third party.
  2. Allow a third party to obtain or view Score Data stored in Personal Cloud.
  3. Copy app data or register devices by improper means for the purpose of circumventing device registration limits.
  4. Engage in conduct specified in Articles 8 and 9 of the Terms of Use.

Article 4 — Registered Devices

  1. Personal Cloud may be used only on devices registered and authenticated to the same account. Each subscription plan specifies the maximum number of simultaneously registered devices and the total number of devices that may be registered during the preceding 365 days; these limits are displayed in the app.
  2. Devices are identified by converting an identifier generated by the operating system or app into a matching value that cannot be reversed to the original. On iOS, the primary identifier is stored by the app in protected device storage, supplemented by an operating-system identifier. On Android, an operating-system identifier is used. Ordinarily, removing and reinstalling the app or re-registering a deregistered device is treated as the same device, without counting it as new. However, device reset or replacement, operating-system or storage conditions and similar circumstances may prevent recognition and result in a new-device count. If the same device cannot be recognised, the user may, once in each 365-day period, make an in-app declaration to register it without counting it as new. Contact us about adjustments to limits for other circumstances.
  3. Devices are deregistered through the account management screen. Synchronisation stops on the deregistered device, but we do not delete Score Data already stored on it.
  4. If a plan change causes registered devices to exceed the limit, the user selects devices, up to the limit, to continue synchronising. Devices not selected stop synchronising, but Score Data already stored on them is not deleted.
  5. We may deregister a device when 180 days or more have elapsed since its last synchronisation. If an email address is registered, we notify it of the deregistration.

Article 5 — Fees and Subscription

  1. Personal Cloud is a paid feature. Plans, prices, capacity, device counts, billing cycles and other conditions are displayed in the app and in App Store or Google Play. Payment and automatic renewal follow the relevant store's terms. Plan changes are made through the store's procedures, and their effective timing follows the store's terms and in-app displays. While subscribed, the capacity for Score Data stored on the device through the app equals the subscribed plan's capacity. Cancellation methods, refunds and purchases by Minors follow Article 6 of the Terms of Use. While a Personal Cloud subscription is active, ads are not displayed.
  2. When the subscription's validity period ends, we retain stored data for 30 days from its end (the grace period). During this period, stored data may be retrieved only by devices registered before the subscription ended and still validly registered at retrieval. If a new registration or re-registration is needed because of device replacement, app reinstallation, deregistration or similar circumstances, that device cannot retrieve data unless the subscription is resumed, even within 30 days after expiry. New storage and updates are unavailable during the grace period. After grace, stored data moves to cloud trash for 30 days and is then deleted. Resuming the subscription during grace or cloud trash restores the stored data. Device registration is cancelled when data moves to cloud trash. Register devices again after resuming; the same device is not counted as new. If automatic renewal has merely been stopped in the store and the subscription still has time remaining, subscribed conditions continue until that period ends.
  3. After the subscription's validity period ends, scores normally usable in the app are limited to the count and capacity for “Registered, no active paid subscription” in Schedule 1 of the Terms of Use.

Eligibility is determined for scores in the list outside trash, in order from most recently updated. A score that does not fit within the capacity limit is excluded, while older scores that fit within the limits may remain usable. Excluded scores remain listed but cannot be opened.

Eligibility is recalculated when the list changes. A score that becomes eligible after organisation, such as moving other scores to trash, can be opened again without resuming a subscription. Resuming the subscription removes this viewing restriction caused by expiry.

Score Data already stored on a device is not automatically permanently deleted because the subscription ends. Voluntary account deletion is governed by the next paragraph and Article 18 of the Terms of Use.

  4. When an account is deleted, all data stored in its Personal Cloud is deleted and all devices are deregistered. The grace and cloud-trash periods in paragraph 2 do not apply to account deletion. Scores already on devices are not forcibly and permanently deleted because the account is deleted. Including scores previously used without registration, the most recently updated scores remain listed up to the count limit for “Unregistered (including after account deletion)” in Schedule 1 of the Terms of Use, and other scores move to local trash. Scores already in local trash are also retained. Other devices perform the same organisation when they confirm account deletion. Restrictions when capacity is exceeded, their exceptions and restoration conditions follow Article 18 of the Terms of Use. Device and subscription history is handled under Article 10. Store subscriptions are not automatically cancelled; users must cancel them in the store.

Article 6 — Responses to Reports

  1. If we receive a report of infringement or misuse through the channel in Article 7, we examine how specific it is and, as necessary, contact the user concerned to establish the facts.
  2. We do not suspend use or delete stored data merely because a report has been made.
  3. We do not view the contents of stored data to investigate a report without the user's consent. If we consider viewing necessary, we explain the purpose, information and scope to be examined and the period, and seek consent in advance. Refusal alone does not lead to restrictions. Consent may be withdrawn at any time, and examination ends after withdrawal.
  4. We do not disclose the reporter's information to the user concerned.

Article 7 — Reports and Inquiries

Reports of infringement or misuse are accepted through “Contact us” in the app, using the category “Copyright or rights infringement”. Bug reports, requests and other inquiries are also accepted through in-app “Contact us”. Using this feature requires sign-in as a Registered User. If you cannot sign in, use support@mail.emmu.jp or https://emmu.co.jp/contact.

Article 8 — Restrictions on Use

If a violation of these conditions or the Terms of Use is confirmed, we may suspend Personal Cloud, suspend the account or take other necessary measures under Article 17 of the Terms of Use.

Article 9 — Responses Required by Law

Responses to statutory disclosure requests or lawful requests from investigative or other authorities are handled under the law and Privacy Policy, separately from the consent-based review in Article 6.

Article 10 — Data Handling

  1. We handle Score Data stored in Personal Cloud only for user-directed storage, synchronisation and deletion, and the following maintenance necessary to provide them: (1) verification of stored data integrity; (2) management of storage capacity; (3) deletion of expired trash and unreferenced files; (4) deletion on subscription expiry, account deletion or suspension; (5) encryption at rest and in transit; (6) disaster-recovery backups; (7) review under Article 6; and (8) responses under Article 9.
  2. We do not view, process, convert, analyse, publish, sell, disclose to third parties, use for advertising or machine learning, or otherwise use Score Data for purposes outside the preceding paragraph.
  3. To provide Personal Cloud, we handle device registration information (app installation identifier, matching values of device identifiers generated by the operating system or app, device name, operating-system type, app version, registration and deregistration times, last synchronisation time and reinstallation declarations); subscription information (purchase store, plan, product, period, subscription, renewal, cancellation and refund status, test-purchase classification and matching values of store transaction identifiers); storage usage, synchronisation status and quantities of data retrieved; inquiry details (category, body, inquiry number and identifier of the submitting Registered User); review consent requests and responses; and records of staff viewing. Device matching values are used to recognise the same device, manage registration limits, authenticate registered devices and prevent misuse. Original device identifiers are not transmitted to or stored by us. We may store the original App Store transaction identifier encrypted to revalidate subscriptions from the server. Purchase information handling is also described in Article 2 of the Privacy Policy.
  4. We retain the preceding information only for the period necessary to provide Personal Cloud, manage registered-device counts, verify subscriptions, respond to inquiries and prevent misuse. Retention periods and starting points for each information type follow Schedule 2 of the Privacy Policy. We distinguish active subscription information, minimal histories of ended subscriptions and plans, and operational records concerning devices, inquiries and viewing, and delete information no longer needed. Preservation for legal requirements or specific disputes and disaster-recovery backups also follow that Schedule.
  5. For support, staff may check subscription status, storage capacity and score counts, and registered devices' counts, operating-system types, registration times and last synchronisation times; we retain records of those checks. Score contents, titles and device names are viewed only under the consent procedure in Article 6 or the responses in Article 9, and viewing records are retained.
  6. The disaster-recovery backups in paragraph 1 are for us to restore the Service; they do not promise a function allowing users to retrieve data from any chosen past point or permanent retention of Source Materials. This explanation does not change displayed retention periods or deletion conditions, our statutory management duties or the rights protected by Article 19 of the Terms of Use and the additional regional terms.
  7. Creator and composer attribution, notes, rights and usage conditions, collecting societies, license numbers and creator-account identifiers within eligible scores are also handled under this Article's purposes and the access conditions in Articles 6 and 9.

Article 11 — Changes

Changes are published and acceptance is requested on the next use of Personal Cloud.

Regional Supplement: Australia, New Zealand and Singapore

1. Consumer Rights

The Terms of Use regional supplement also applies to this feature. Provisions on prices, refunds, warranties and liability do not restrict non-excludable rights or remedies. A store procedure does not relieve us of our own duties.

2. Information Before Purchase

Check the displayed selling price and currency, billing period, automatic renewal, capacity, device limits, timing of plan changes, cancellation method and post-termination handling. App display language is distinct from the store's purchase region and currency. Where a transaction is displayed tax-inclusive, the store shows the tax-inclusive total.

3. Cancellation, Refunds, Account Deletion and Data

Stopping automatic renewal does not immediately delete your account. Ordinary cancellation leaves subscribed features available until the store's stated end date. Where an entitlement ends through a refund, rescission or another reason, handling follows that end time. After termination, Article 5's grace and deletion process applies. Even during grace, downloads require a device registered before termination; devices needing new registration require a resumed subscription. Account deletion instead removes the relevant server data through the deletion process, without the subscription grace period. Account deletion alone does not stop store recurring billing. Before these actions, lawfully export and separately retain necessary data.

4. Storage Scope and Reports

Private cloud storage does not authorise storage contrary to copyright or other law. Do not use it as a general store for images or files unrelated to scores. Reports of infringement or unlawful use and lawful authority requests are handled under Article 9, the Terms and Privacy Policy. Ordinary support investigations retain Article 6's consent and access-scope restrictions.

5. Storage, Restoration and Responsibility

Independent retention, synchronisation and recovery backups have the roles explained in Articles 1 and 10 and Articles 7 and 13 of the Terms of Use. Article 19 and section 8 of the Terms of Use regional supplement govern compensation for data loss and related events. Failure to retain Source Materials separately does not by itself release us from all liability. Ordinary inquiries are distinct from formal service of judicial documents, which is governed by Article 22(5) of the Terms of Use.

Additional Regional Terms: Taiwan, Hong Kong, the United States, Canada, South Korea, India, Mexico, Argentina and Chile

The applicable additional regional terms and information in the Terms of Use, Privacy Policy and Child Safety Policy also apply to this feature. Local rights to withdrawal, refunds, compensation and personal information protection are not excluded by store procedures or limitations of liability in these Terms.

1. Contracts, Withdrawal and Renewal Notices

For cancellation and withdrawal periods, including seven days in Taiwan and South Korea and ten days in Argentina and Chile, the applicable starting points, scope and exceptions apply. Taking account of continuing storage and synchronization, we do not treat all performance as completed immediately upon commencement of supply. Applicable additional requirements, including notices under US state laws, Mexico's notice five calendar days before automatic renewal, and pre-contract French-language presentation in Quebec, Canada, follow the additional regional terms in the Terms of Use.

2. Data and Overseas Transfers

Score files, management information and operational records are subject to the purposes, retention periods and methods of exercising rights stated in the Privacy Policy. Where specific disclosures or consent for overseas transfers are required, including in South Korea, we provide explanations and complete procedures before the relevant information is transmitted. Required verification involving parents or guardians of minors is also completed before the relevant information is collected or transmitted.

3. Cancellation, Deletion and Backups

Stopping automatic renewal, statutory withdrawal or refunds, and account deletion are separate procedures. Post-cancellation use periods, grace periods, retrieval by already registered devices and deletion of server data upon withdrawal from membership follow Article 5 and the Terms of Use; more favorable mandatory legal requirements take precedence. Please also retain necessary originals somewhere that does not depend on account sign-in or synchronization. Failure to keep originals separately does not by itself categorically relieve the Company of legal liability; causation, foreseeability, mitigation of loss and other statutory requirements apply.

4. Rights Infringement and Complaints

Storage exclusively for personal use does not authorize use contrary to the copyright laws or permissions applicable in the region of use. We respond to lawful infringement notices and requests from authorities, while maintaining Article 6's consent and scope limitations on viewing content in ordinary support. Inquiries are accepted through the contact channel in Article 28 of the Terms of Use, without obstructing the right to use local authorities or courts.

Additional terms on age, purchase approval and Switzerland

The additional terms on age and parental or guardian verification and the explanations concerning Switzerland in the Terms of Use, Privacy Policy and Child Safety Policy also apply to this feature. Approval for account registration is separate from approval for paid recurring purchases.

Parental or guardian purchase approval covers the displayed product, price, currency, billing period, automatic renewal, price after renewal and cancellation method. If the covered conditions change, we do not simply reuse the previous approval. A purchase is not treated as completed until the contract is concluded on the store's purchase confirmation screen. We accept post-purchase verification and restoration of purchases and do not cause records of paid transactions to be lost because eligibility is being rechecked.

If required approval is withdrawn or we learn that age requirements are not met, we stop new purchases and the relevant ordinary synchronization. We do not automatically delete originals on the device, and we explain procedures for inquiries, cancellation, and export and deletion of originals after authority has been verified. Withdrawal of parental or guardian approval or suspension of an account alone does not cancel automatic renewal in the store.
